By ordering services and / or products from Bodin you declare that you have read these General Terms and Conditions, have understood them and that you agree to comply with all provisions described in this agreement. GENERAL TERMS AND CONDITIONS, PRIVACY POLICY & DISCLAIMER v.5.1

This agreement applies to all customers who use Bodin services, including: Products and services regarding web hosting / domain names offered on Bodin. Products and services offered on other related domain names and websites owned by CoreCom bvba.

Privacy Policy: Bodin respects your privacy. You can visit our websites without revealing any personal information about yourself. We do collect statistics from visitors such as the internet address of the domains of the persons who visit our website, but only with the aim of improving the content of our websites. When you place an order for one of our services, the collected personal information will be treated with strict confidentiality. This information is only used to process your order and to provide you with the best possible service. We will never pass on your data to third parties, except in legal proceedings. Upon request, we will send our customers any information we hold about them.

This agreement is concluded between Bodin, Branstraat 35, 9830 Sint-Martens Latem (hereinafter referred to as “Louis Baetens”, “Bodin” or “the company”) and all customers who order a service or product from Bodin through one of its websites , post, telephone or fax (hereinafter referred to as “the customer”). This agreement takes effect from the moment of placing and / or sending an order:

Article 1.0 Communication and responsibility:

1.1 All communication with the customer (including order, renewal, billing and information) takes place via the email address with which the customer registered when ordering. It is therefore VERY IMPORTANT and the customer is responsible for reporting any change to this email address immediately. info@Bodin.be. The customer understands that negligence can have serious consequences and in the case of renewals can even lead to the loss of his domain name and / or data.

1.2 The customer is responsible for providing his data and declares in good conscience their correctness. If the customer wants to change his data, this can be requested. It is possible that documents are requested confirming the changes to his personal data. This change relates to the privacy Policy described above.

1.3 Customers outside Belgium, within the EU must keep their data optimally up to date. Since January 1, 2010, the legislation on intra-Community transactions has been amended and aligned across all European countries. The Belgian state will take strict action and sanction relevant companies if applicable. Every Belgian company, including Bodin, must submit an intra-Community statement every month. You are included in this list. If the Belgian state determines that the data of your VAT number is not active during the billing period and / or the data does not match, the relevant traders will be written to do the necessary. Any company can be sanctioned with a fine. In that case, Bodin will focus on the person ultimately responsible, according to the customer, and reclaim this fine when this occurs. This means Bodin has more administration work and these are not included in our services when the customer is in default of providing correct information. That is why Bodin has decided to automatically charge an administration fee of 25 to 125 euros here. When Bodin is sanctioned by the Belgian government, these costs will also be charged to the customer.

Article 2.0 Start, Extension and End of Agreement:

2.1 All rates on our website are indicated on an annual basis and include VAT, unless explicitly stated otherwise. All Bodin services are based on prepayment. By placing an order, the customer agrees to the rates indicated by Bodin. Prices can be changed unilaterally by Bodin. Bodin undertakes to inform the customer in advance of these price changes. When the payment has been received, the order can no longer be canceled unless otherwise agreed.

2.2 Bodin reserves the right, in the absence of timely payment, to cancel an order or extension within 7 days after placement or extension, without prior notification or notice of default.

2.3 The customer (law on distance contracts) has a period of 7 working days after order within which he can cancel the agreement. After this period, cancellation is no longer possible and the customer must make the payment for the ordered service or pay a fee of 9.95 euros, including VAT. If the customer makes a payment before the end of the period of seven working days, the delivery of the services will already be performed and the customer and Bodin agree that the right of renunciation cannot be exercised. The customer does not have a right of renunciation when he opts for a direct invoice, as it concerns an agreement concerning products that are manufactured according to the specifications of the consumer or that have a clearly personal character.

2.4 The month before the expiry date of the domain or account you will receive an email from Bodin informing you of the fact that your agreement is about to expire and you have the option to cancel in time up to 7 days before the expiry date. For security reasons, cancellation can only be done via the contact form on 'www.bodin.be' or by registered mail. In case of late cancellation, the customer always owes a payment. A transfer of a domain name is never equal to a cancellation. Additional costs as a result of late payment are always borne by the customer. The customer understands that a late payment can result in the loss of domain name, even at that time the customer still owes the payment and can choose a new domain.

2.5 An automatic renewal can be done at the request of the customer, the domain / account will then be automatically renewed and an invoice will also be created. In case of renewal, the customer will be notified by e-mail 40 days before the expiry date that his account / domain name will expire. You then have another 20 days to cancel your account / domain. In case of non-cancellation, the invoice will be generated automatically twenty days before the expiry date and your account / domain will be renewed. Cancellation or change is then no longer possible or in certain cases subject to payment of an administrative fee.

2.6 All invoices are delivered to the customer by post. An invoice can also be sent by email at the express request of the customer.

Article 3.0 Illegal Activities:

3.1 Bodin's services may only be used for legal purposes. For these reasons, we will not provide services to those who use our services for, among other things (the list below is not exhaustive): 3.1.1 Hacking or unauthorized access (or attempt to access) an account, computer, server, or network. Scanning of ports or firewalls and 'phishing' (fraudulently trying to find out data) techniques are also not allowed. 3.1.2 Hosting or offering files, software, torrents or music for which you do not have permission or license. 3.1.3 Sending spam or bulk sending unwanted commercial or other emails. Bodin has a very strict policy in this regard. 3.1.4 Violation of intellectual rights, copyrights, trademarks, privacy and other legal rights. 3.1.5 Hosting or providing any material that is threatening, illegal, offensive, obscene, offensive or material that Bodin believes is inappropriate. 3.1.6 Hosting or offering child pornography is strictly prohibited. If this information is discovered, Bodin will immediately notify the competent legal authorities. 3.1.7 Hosting or offering software or files that contain computer viruses or files that can cause damage to computers and / or servers of others. 3.2 By accepting the General Terms and Conditions, the customer gives permission to the company to pass on the customer's data to the legal authorities in case of established infringements. Bodin is not responsible for the content posted on its hosting packages.

Article 4.0 Acceptable Use of and Access to Services:

4.1 Bodin does its utmost to provide you with the best possible service. We therefore ask that you treat our employees with the necessary respect and professionalism. Disputes or problems must therefore be reported to us so that it is possible to find an appropriate solution. The information provided by Bodin to the customer is therefore confidential and may not be made public. For urgent matters such as server or network downtime, we can be reached 24/24 via SMS on our mobile emergency number 0032-495.928.056. We ask customers not to abuse this number.

4.2 The following content is NOT allowed (unless with the express permission of Bodin) on Bodin's accounts, in case of doubt you can always consult a representative of Bodin. 4.2.1 Websites with adult (+18) or pornographic content. 4.2.2 Online game scripts such as criminals. 4.2.3 Chat Software. 4.2.4 Streaming audio and video. 4.2.5 Proxy servers or script. 4.3 On accounts with unlimited data traffic, most of your images, download files, etc. should be linked from an HTML or equivalent web page that is accessible to the public and your website should consist for the most part of web pages and images used on these pages. Your website must not be primarily designed for making files available for downloading and the data traffic caused by one or more of your downloads must be in reasonable proportion to the consumption of the rest of your website.

Bodin will only act here in case of problems with CPU or memory usage. All Bodin accounts with the qualification “unlimited data traffic” will start with a limit of 99 GB per month. If you have used up 80% of your bandwidth, you can simply contact our technical service for an increase. At that point we will check whether your account meets the conditions and increase the bandwidth limit again by 99 GB.

4.4 Unbridled use of our services is not allowed. Your account should never overload the server in such a way as to hinder other customers, limit the speed of the server or cause a high load. Bodin has the right, if your website uses more than 10% of the CPU or memory of the server resources, to take the necessary actions to avoid further problems with the server.

Article 5.0 Additional consumption:

5.1 Customers with an account with a restriction of data traffic can upgrade to a higher package if exceeded.

5.2 Customers with an account pay EUR 0.60 per GB more data traffic used. These amounts will be invoiced as soon as the amount has reached a certain amount, in order to limit the administration costs. One can also opt to increase the data traffic from the 2nd month after this increase has been requested.

5.3 Specialized technical support for matters outside our standard service provision is charged at EUR 15 per quarter hour commenced (excluding VAT).

Article 6.0 Domain Name Services and Registrations:

6.1 Domain name registration is included as part of some hosting plans. A transfer of a domain name is equivalent to a registration. Bodin will always register all domain names in the name of the customer and this according to the information provided by him. The customer is responsible for the correctness of the data, and any changes to it. Changes to certain data on a domain name can incur additional costs. Costs arising from the provision of incorrect information will be passed on to the customer. With .nl domains, the customer gives Bodin the power of attorney to sign the necessary SIDN documents and registration forms on his behalf (Bodin reserves the right to ask the customer to forward or fax the necessary documents).

6.2 The customer accepts that when registering a domain, he must comply with the regulations of the individual domain name suffixes as determined by eg DNS.be for .be domains, SIDN.nl for .nl domains or ICANN.org for. com, .net, .org, etc… domains. It is the customer's responsibility to check these provisions on a regular basis.

Article 7.0 Liability:

7.1 Bodin's services are provided upon availability. The use of the customer of a service at Bodin is entirely at his / her risk. The bvba Bodin or one of its managers, staff members, employees, resellers, partners can never be held liable or held responsible for any damage that customers may have suffered through the use or misuse of information, content or services provided by Bodin, including direct or indirect damage as well as loss of data due to unavailability, suspension or discontinuation of services, regardless of the reasons for this.

7.2 The customer is responsible for any misuse of his account. Therefore it is recommended to take the necessary steps to prevent others from gaining access to the account. even if this abuse was committed by a friend, family member, guest or employee. Therefore, it is recommended that you take the necessary steps to prevent others from gaining uncontrolled access to your account.

7.3 Bodin cannot be held responsible under any circumstances for the operation, failure or interruptions of services provided, including (but not limited to) the loss of website data, loss of backup data, the inability to provide a recent copy of lose your website or data, website downtime, due to website unavailability. Although Bodin makes every effort to handle the data of its customers with care and provides internal backups of all data, the customer understands that due to the technical nature of the service a backup is not guaranteed. The customer remains ultimately responsible for the necessary backups of his data on our accounts.

Article 8.0 Financial and Legal Information:

8.1 The invoices are payable in Schoten, in cash and without discount.

8.2 All complaints regarding the services or the content of the accounts must be made by registered letter within 8 days after receipt of the invoice. They do not suspend the payment obligation.

8.3 Bodin reserves the right to temporarily suspend, limit or shorten services in the event of non-payment or late payment of amounts charged.

8.4 For every delay in payment, after 30 calendar days, an interest of 12% per year and a fixed compensation of 15 %, with a minimum of 125 euros, is due by operation of law and without notice of default. This fee does not include protest and court costs. These costs are also borne by the debtor.

8.5 In the event of a dispute, the Justice of the Peace of Merksem, Commercial Court or Court of First Instance in Antwerp is competent, regardless of the client's place of residence.

8.6 The current sales conditions have been formally and expressly accepted by the customers.

8.7 A payment from a customer that cannot be linked to an open order, extension or invoice will be billed as a prepaid payment. This prepaid amount will automatically be deducted from the next order or extension. Bodin reserves the right to use any incoming payment for the oldest outstanding amount due, regardless of what is stated in the payment.

Article 9.0 Miscellaneous:

9.1 Prepaid sums are never refunded regardless of term or amount.

9.2 In the event of a violation of one of the rules of our General Terms and Conditions, we have the right to suspend or terminate your account temporarily or permanently, without prior notice. We prefer to advise our customers first of any violations, misconduct and any other form of correction that is necessary, but serious violations of the Terms and Conditions will result in immediate discontinuation of our services to the customer. Any violation of these General Terms and Conditions will result in a cost payable to Bodin of at least 50 euros per complaint or violation and / or suspension or suspension and termination of your account and this without prior notification to the customer and without refund of sums already paid. The customer understands that these damages can increase according to the seriousness of the complaint and that they are not limited, all costs will be fully or partially recovered from the customer. Bodin is not responsible for damage and / or data loss as a result of the discontinuation of the service in the event of violations of the General Terms and Conditions. Amounts paid remain the property of Bodin. Bodin reserves the right, in the event of a breach, to terminate your account, as well as further business relationships with You, for any suitable reason at any time. No further discussion is possible about this decision. We will do our best to assess each case individually and handle it with common sense, taking into account the technical and social implications of the situation.

9.3 When a requested trade or move is not feasible for reasons outside Bodin, the customer will always owe a cost of 10 percent of the amount paid with a minimum of 25 euros or this domain will be converted into an existing domain where the customer via name server referral can use the hosting.
